Terms and Conditions

Welcome to the website of the Continuing Education Center (CED), a division of the Yonsei University College of Dentistry. The mission of CED is to (a) provide continuous and systematic education for dental professionals on not only the latest dental clinical skills, techniques, and materials, but also recent research trends in dentistry, based on proven knowledge and experience, and (b) cultivate qualified dental professionals by establishing a sense of responsibility and a sense of mission. The CED is committed to delivering excellent and comprehensive patient care within the field of dentistry to play a significant and leading role as a dental educational institution.

Please read all of these terms and conditions carefully before using this website. By using this website, you accept and agree to be bound by these terms. If you do not accept these terms, do not use this website.

Chapter 1: General Provisions

Article 1. Purpose
The purpose of these Terms and Conditions is to set forth the conditions of use of services and process between Continuing Education Center at Yonsei University College of Dentistry (collectively, hereinafter referred to as the "CED", "us", "we", or "our") and the Member; and the rights, responsibilities, liabilities and other necessary matters between the CED and the Member in connection with using services (which mean internet-based remote related services and the like as provided by the CED to enable the Member to use remote support and remote related services through the terminals including PCs, portable terminals, and various other wired and wireless devices and on and through internet).
Article 2. Definitions

As used in these Terms and Conditions, the following terms shall have the respective meanings set forth below:

  • "Service" refers to all online services provided by the CED to the Member through the website.
  • "Member" refers to those who use the services provided by the CED based on an ID and Password granted by connecting to the CED’s website and agreeing to these Terms and Conditions.
  • "ID" refers to a unique code based on a combination of letters and numbers as selected by a Member and approved by the CED necessary for personal identification and service use.
  • "Password" refers to a combination of letters and numbers and/or character as selected by a Member to be linked to the Member’s ID to protect personal data on and through communication.
  • "Service Charge" refers to the usage fees to be paid to the CED by the Member for the purpose of service use.
  • "Service Use Agreement" refers to an agreement to be executed by and between the CED and the Member connection with the service use.
  • "Term" refers to the predetermined period for the Member to enable to use the Service upon using the fee-charged service.
  • "Termination of Contract" refers to termination of Service Use Agreement by the CED or the Member after opening the Service.
  • "Rescission of Contract" refers to cancellation of Service Use Agreement by the CED or the Member before opening the Service.
  • "Temporary Suspension of Service" refers to the suspension of services for a certain time pursuant to certain requirement and policy set by the CED.
  • "Service Open Date" refers to the date on which the CED has taken and completed the necessary measures for the Member to enable to use the Service after the Member requested to use such Service.
  • "Change Date" refers to the date on which the CED has taken and completed the necessary measures to meet the Member’s request for change after the Member requested to change the contents of Service.
  • "Illegal Communication" refers to the communication including obscene contents, defamation of others by slanders and false accusations, intellectual property infringement such as piracy, national secrets infringement, and media contents harmful to minors under Youth Protection Act.
  • "Payment Service Provider" refers to the agency specializing in electronic payment services designated by the CED for the User to enable to choose various payment methods.
Article 3. Terms and Conditions Effectiveness and Amendment
  • The Terms and Conditions shall take effect in all Members of the CED.
  • The contents of these Terms and Conditions, as well as the address, representative's name, business registration number, contact information (phone, fax, e-mail address, etc.) will be visible on the initial service screen of the website so users may see it.
  • The Members who have been registered as the member by agreeing and acknowledging expressly that they consent to these Terms and Conditions shall be subject to the Terms and Conditions upon consent hereto; whereas in the event where these Terms and Conditions are amended, then the amended Terms and Conditions shall be applied to the Members upon the effectiveness of such amendment.
  • The CED’s Terms and Conditions may be changed so long as it does not violate the range of any of the following laws:
    (a) Act on the Regulation of Terms and Conditions and
    (b) Act on Promotion of Information and Communications Network Utilization and Information Protection.
  • The CED, as it deems necessary and in its discretion, may amend or modify these Terms and Conditions. In the event of amending these Terms and Conditions, the CED will specify the contents and effective date of such amendment and post online on the website or provide notification to the Members by an email by no later than 30 days prior to the effective date. The amended Terms and Conditions shall take effect on such post or notification of effective date described in the above.
  • Any member who does not agree on these Terms and Conditions as emended or modified, may terminate the Service Use Agreement by discontinuing use of the Service (withdrawal of membership). Provided, however, the Member may be deemed to have consented to the amended Terms and Conditions if the Member fails to withdraw from the Service within 30 days mentioned in the above.
Article 4. Application of Terms and Conditions, and other Rules
The CED may provide the separate terms and conditions and rules for specific services based on natures and characteristics of service. Any matters that are not set forth in these Terms and Conditions will follow the applicable laws and regulations and the CED’s separate terms and conditions and rules and the like.

Chapter 2: Service Use Agreement and Membership Management

Article 5. Execution of the Service Use Agreement and Application for Use
  • The Service Use Agreement is established between the CED and the Member when the Member desiring to use the service provided by the CED agrees to these Terms and Conditions; applies for service use in accordance to the form and procedure presented by the CED; and the CED approves such application.
  • The Member’s express consent to these Terms and Conditions shall be completed when the Member desiring to use the service clicks button “I Agree” on these Terms and Conditions upon application to use service.
  • Upon execution and establishment of the Service Use Agreement, the CED provides the Member with member pursuant to these Terms and Conditions. In principle, such Member ID shall not be changed. Provided, however, if change is necessary due to unavoidable reasons, then the Member shall apply for a new ID after cancellation of the previous ID.
  • All information entered on the online application form deems to be real data and any Member who have not entered the legal full name or real information shall not be legally protected.
  • Unless there are any problems or difficulties in these Terms and Conditions, business and technicality regarding application of members, the CED will, in principle, approve the use of service. Provided, however, the CED reserves to approve the application in the event of any of the followings.
    • If the application has been made with any other person’s name instead of applicant’s real name.
    • If the person has applied with false information on the application or attached false documents.
    • If there are concerns against social norms or public orders and morals.
    • If the applicant is registered as a delinquent borrower under the Law on the Use and Promotion of Credit Information.
    • If there are unpaid fees owed to the CED.
    • In case of insufficient facilities for the Service or technical or business difficulties.
    • It is difficult to approve for any reason attributed to the Member.
    • Any other reasons deemed necessary by the CED

Chapter 3: Obligations and Responsibilities

Article 6. Changing Member Information
  • The Member may review and modify the personal information at any time through the personal information management screen. Provided, however, any real name and ID, which are necessary for service management, must not be modified.
    • Changes in the CED name of the Member and the person responsible for paying fees, name, address or contact information,
    • Changes in the content of services (type, contract period and the like.), or
    • Change in the payment method
  • If any matters entered at the time of applying for Member registration have been changed, such Member shall modify them online or notify the CED of such changes by an e-mail. The CED shall not be held liable for any disadvantages resulting from the Member’s failure to notify the CED of such changes.
Article 7. Obligations to Protect Personal Data
  • The CED makes efforts to protect the Member’s personal data including the Member’s registration information in accordance with the applicable laws and regulations.
  • The applicable laws and regulations and the CED’s personal data management policy apply to the protection of personal data of the Member. Provided, however, the CED’s personal data management policy will not apply to any linked websites other than the CED’s official one. Also, the CED shall not be held liable for the information exposed due to reasons attributable to the Member.
Article 8. Obligations to Maintain Member’s ID and Password
  • The Member must thoroughly manage the Member ID and Password.
  • The Member shall be responsible for all the consequences caused by the illegal use and negligent management of Member ID and Password and the CED shall be responsible for problems caused by reasons attributable to the CED such as breakdown of the CED’s system.
  • The Member shall not allow any third party to use the Member’s ID and Password. If the Member becomes aware that his/her ID and/or Password was stolen or is being used by the third party, then such Member shall notify the CED of such immediately and follow the CED’s instruction accordingly.
  • The Member may not lend or transfer the right to use Service and other contractual status and interest of Service Use Agreement to the third party and, nor offer it as collateral. If the Member conducts such act, the CED may limit the Member’s use of service and the member is solely responsible for the consequences of above acts.
  • The Member’s ID may not be changed without the prior consent of the CED.
Article 9. Notifications to the Member
  • The CED may notify the Member by using the e-mail address or contact information (telephone and mobile phone) submitted to the CED by members.
  • In the case of notification to many and unspecified members, the CED can substitute individual notifications by posting them on the website and relevant service site at least for 7 days.
Article 10. CED’s Obligations
  • As long as there are no business and technical difficulties, the CED provides the Service a year-round (24 hours / 365 days). Provided, however, this excludes routine or non-routine maintenance conducted for stabilization of the Service.
  • The CED shall immediately process any opinion or complaint raised by any Member regarding the use of the Service that is acknowledged as being justifiable. However, if the immediate handling is difficult, the CED shall notify the Member of the reason and schedule via e-mail or telephone.
  • The CED shall not distribute to any other persons the Member’s information obtained in relation to the provision of the Service without a prior consent of such Member. Provided, however, it may exceptionally be used if requested by the relevant authorities for the purpose of the investigation in accordance to the relevant laws and regulations; at the request of the relevant government authority.
  • The CED complies with applicable laws and regulations related to the operation and maintenance of Service including the ‘Act on Promotion of Information and Communications Network Utilization and Information Protection’ and the ‘Private Policy.’
Article 11. Member’s Obligations
  • When applying for membership, the Member shall enter all details based on the fact; provided, however, that if registered a false or someone else’s information, such person shall not be entitled to claim any rights whatsoever.
  • The Member in using the Service provided by the CED should not conduct each following subparagraph.
    • Entering false information when applying for membership registration or modifying member information or stealing or fraudulently using another Member’s ID and password.
    • Trading Member’s ID or account with others.
    • Defaming or giving disadvantage to another person.
    • Linking obscene sites or posting obscene material on the board and etc.
    • Infringing the CED’s intellectual property, third party’s intellectual property and other rights.
    • Disseminating the information, statements, graphics and audio to others against social norms or public orders and morals.
    • Registering or spreading computer virus infected data that causes malfunction of equipment associated with the Service, destruction of information and induction of confusion.
    • Using the Service by exploiting a bug in the program.
    • Intentionally interfering with the service operation.
    • Modifying posted information on the CED’s website/page and transmitting or posting information (computer programs) other than information posted by the CED.
    • Posting or sending via e-mail, data including software virus, other computer code, file and program designed with a purpose to disturb and destroy the normal operation of computer program, hardware and telecommunication equipment.
    • Collecting or storing other Member’s personal information without the CED’s approval.
    • Posting writing or sending an e-mail by stealing someone else’s name or impersonating an employee or an operator of the CED.
    • Other illegal or improper acts.
  • The Member must comply with requirements notified by the CED such as applicable laws and regulations, these Terms and Conditions, guidelines, instructions and notices; and shall not engage in any acts that interfere with the business of the CED.
  • The Member shall be liable to pay the fees established on these Terms and Conditions for consideration of using the Service; and the Member shall be liable for any and all problems arising from or caused by unpaid service charges. Provided, however, this will not apply to cases of reasons attributed to the CED or reasons acknowledged by the CED.
  • If any change occurs in the Member’s information from the time of service application, the Member must immediately notify the CED of the content of such change and the CED shall not be held liable for any matters caused by the delayed notification.
  • If the Member causes a malfunction to the CED’s service, such Member must compensate the CED in full for costs incurred from supplementation, repairs and other constructions and any damages and losses.
  • All problems related to copyrights of all information provided by the Member are at the responsibility of such Member.
  • A fee paid in advance cannot be resold or transferred to other person and the CED shall not be held liable for exchanging or replacing the ID and password provided to Members in cash or other securities.
  • The Member may not assign, transfer, give or bestow the right to use the Service and other contractual status and interest of Service Use Agreement.

Chapter 4: The Opening and Use of Services

Article 12. Opening of Service and Service Hours
  • The CED will commence the Service when it accepts the Member’s user application, provided that for some Services, the CED will commence the Service from the designated date.
  • Except for the case where the CED approves the Member’s application for use and the CED and such Member mutually agree the use of service, the CED will, in principle, open the service when the service fee has been paid in advance according to the procedure presented by the CED.
  • In case where the Service has not been opened due to business or technical difficulties of the CED, the CED will publish such matter to Members on its website or a separate service related website or separately notify by an email and the like.
  • The Members may use Services provided by the CED as set forth in these Terms and Conditions.
  • In principle, the service use is available all year around and 24 hours a day except for the regular system maintenance checkup occurring once a month, as long as there are no specific businesses or technical difficulties of the CED. Provided, however, the CED may limit all or part of the Service for the purpose of system check-up or other reasons.
  • The CED may divide the Service into certain ranges and designate a separate service hour available for each range thereof and in such event, the details thereof will be publicly noticed on the Site.
  • Charged Service may be available for use from date of service application or its separate commencement date by services.
  • User hours of Service subject to billing is to be determined by the policy of relevant financial institutions and the CED will give a prior public notice in the page of the Service.
Article 13. Modification and Suspension of the Service
  • The CED may, at any time in its sole discretion and necessity, change or supplement the contents of the Services, without any prior notice. If necessary, the CED may post the changes or supplement to the content of the Service on the service related website or separately notify by an email and the like.
  • The CED may temporarily limit or suspend the offering of Service in entirety or part in any of the following cases:
    • When the key telecommunications business operator specified in Telecommunications Business Act suspends telecommunication services;
    • When it is inevitable due to works for maintenance, repair, or checkup of service – information communication facilities;
    • When the normal use is difficult due to blackout, breakdown or interruption of various facilities or congestions of usage;
    • When the force majeure occurs such as natural disasters and national emergency, or
    • When the CED believes it necessary to suspend the service due to technical or business difficulties.
  • In the event of the suspension of services, the CED will notify the Members in a way as set forth in Article 9 (Notification to the Member); provided, however, if the CED is prevented from providing an advance notice for any unavoidable reasons, then the CED may publish the notice on its website or the separate service related website after any suspension.
  • The CED shall not be held liable for any damages to Members in the event that service is temporarily suspended due to causes stipulated in Paragraph 1.
Article 14. Information Sharing and Posting of Advertisement
  • The CED may provide the Member with various information that is considered necessary to use the Service through public notices or via electronic mail (e-mail); provided that each Member may decline at any time receipt such electronic mails.
  • The CED may place advertisements related to the Service operation via the Service-related application program screen, homepage, electronic mail, etc. The Member may express to the CED that it declines receipt of any electronic mails with an advertisement.
  • It is a matter of the issue between the Member and advertiser that the Members uses the advertisements posted in the Service, communicates or trades in the manner of participating sales promotion activities of advertiser through Service. Even in case of occurrence of any problem between the Members and advertiser, the Members and advertiser must directly resolve such problem and the CED will never responsible therefore
  • The CED will not responsible for guarantee any transaction to be made with the Member through the services which the sites linked through hyperlink independently provide
  • The Member may reject to receive at any time an e-mail for providing information except for the transaction-related information as required by applicable laws and Member inquiry, provided that any e-mail which has been already sent as of such rejection may not be stopped for the reason of technicality.
  • The Members may not commit any arbitrary deletion of, slander, or obstructive act on banner AD provided by the CED.
  • The use hours of Service subject to billing must be determined by relevant policy of financial institutions and the CED will give a prior notice thereof in the Service page.
Article 15. Copyrights to Posts
  • Any copyright to the content prepared by the CED and posted in the Site or Service shall be owned by the CED except for those which have been posted by the Members or provided under partnership agreement.
  • Any right and responsibility to the posts posted in the Service by the Member shall be retained by that the Member and the CED has the right to post them in the Service. In addition, the Member cannot use them for other purposes without consent of the Member.
  • Unless otherwise applicable laws and regulations, the Member must be deemed to automatically grant a royalty free, permanent, irrevocable, non-exclusive and sub-licensable license CED with respect to a material at the same time when such Member publicly posts or submits it in the Service.
  • The CED will not liable, civil or criminal for any infringement of the post posted by the Member in the Service on copyright, and program copyright of others. The Member shall make its best effort in indemnifying the CED from any claim such as the one for damage filed by others asserting that that Member infringes on their copyright and program copyright and otherwise, that Member shall be fully liable for damage incurred by the CED caused thereby.
  • The CED may delete a post which has been posted by the Member if the membership of that Member is withdrawn or is duly terminated.
  • No Member may use or allow the third party to use any data posted in the Service or information acquired by using the Service for profit seeking by reproducing, transmitting, publishing, distributing, broadcasting or using in other ways without prior consent of the CED and any infringement on the intellectual property right (IPR) will be subject to the applicable laws and regulations.
  • Any IPR related to this Service or its software, contents included in sponsoring AD which are protective under the laws and information to be provided to the Members through this Service or advertiser will be protected by all applicable laws on IPR including copyright, trade mark right and patent.
Article 16. Deletion of Posts or Contents
  • If any Member’s posts or Member generated Contents in the Service by the Member (including any posts between Members) fall under any of the followings, the CED may delete or remove such posts or contents from the Site or Service or decline the registration itself without any advance notice; and the CED shall not be liable for any claims or losses resulting from deletion or declination of the above.
    • Any content that is engaged in an act to slander or defame the CED, other Members or any third party;
    • Any information, text, graphics, images and the like that contains in breach of or against social norms or public orders and morals;
    • Any content that is deemed to be connected to the criminal activities
    • Any content that infringes any rights including copyrights of the CED and/or third parties
    • Any content that is not related to the Service provided by the CED.
    • Positing any unnecessary or unauthorized advertising or promotional materials
    • Any content that has been falsely made by an unlawful use of an ID, name and the like of other person; or that has been forged or manipulated of other person’s information entered into the Site.
    • Repetitive posts of same contents in multiple times against the purpose of post; or
    • Any content that is deemed to violate any applicable laws and regulations and the CED’s guidelines.
  • The CED may make and enforce the specific Guidelines for use regarding the Member’s posted contents; and the Member shall register or delete each post pursuant to such specific Guidelines for use.
  • If any post or content of Service infringes on the rights of others including privacy infringement, damage on reputation and infringement on copyright, any affected person may request the CED to take measures to stop such infringement through explanation and report to the CED.
  • Upon receipt of such request, the CED may take necessary measures including posting of opposing comment under applicable laws and regulations, deletion and provisional action, inform such measures to applicant and person posting information in the manner such as e-mailing and must let the Member to know it through public notice in relevant bulletin board.

Article 17. Ownership of Rights and Prohibition of Assignment
  • Any and all copyrights and intellectual property rights as to the Service belongs to the CED. The copyright to the content posted by a Member in the Service belongs to the relevant copyrighter of such content.
  • The Member shall not use the information obtained on and through use of Services for profit, nor procure the third party to use it without the consent of the CED.
  • The Member shall not modify, lend, distribute, distribute, sell, produce, assign, sublicense, establish a security interest on, or engage in the commercial usage of the CED’s copyright properties in whole or in part; nor procure the third party to do so.
  • The Member cannot resell the Services provided by the CED to third parties. Provided, however, this excludes cases of signing a separate contract with a purpose of resale.
  • The Member cannot assign, transfer or bestow the right to use the Service and other status of the contract. Any and all rights and responsibilities including copyrights regarding Posts remain in the Member who posted them.
Article 18. Termination of Service Use Agreement
  • In case where a Member intends to terminate the Service Use Agreement, the Member shall submit the application for termination to the CED at least 7 days prior to the termination directly by himself/herself by or through online, telephone, fax, email and the like.
  • Any loss of all information of the Member occurred upon or after the termination of Services at the request for termination by the Member shall be at the responsibility and liability of the Member, and thus the Member shall not make any claim for damages from such loss against the CED.
  • The CED may terminate the Service Use Agreement in case of any of the followings:
    • The Member falls under any of the cases set forth in Article 19 (Limited Use of Services); or
    • The Member’s breach or alleged breach of Article 11 (Member’s Obligations);

Chapter 5. Limited Uses of Services and Etc.

Article 19. Limited Use of Services
  • If the Member falls into each following subparagraph, the CED notifies the relevant Member of the appropriate details in a way set forth in Article 9 (Notifications to Member) or other available methods and then may suspend or limit the Member’s use of Service until the relevant causes are resolved.
    • If it falls under the act against social norms or public orders and morals.
    • Acts of defamation against someone else or giving a disadvantage to others.
    • A large amount of information transmission that can affect the stable service operation and acts of hacking (cracking), spreading computer virus program and sending and intermediating the advertising information.
    • If unauthorized advertisements without the CED’s approval, spam mails, chain letters, pyramid schemes and other forms of offers are posted, shown, e-mailed or sent through other methods.
    • If someone else’s patent, trademark, business secret, copyright, and content that infringes other intellectual property is posted, shown, e-mailed or sent through other methods.
    • If false information was entered when application for membership and application for service use.
    • If other Member’s ID or name was illegally used.
    • If there are violations to other relevant laws or terms and conditions set by this agreement.
  • If a Member wishes to terminate the Service Use Agreement, such person shall apply for termination to the CED on the website (only in the event where the CED allowed the termination to be conducted through the website) or with a separate method determined by the CED.
    • If the Member does not fulfill the obligations of membership as set forth in Article 11, the CED can suspend the use of service or terminate the Service Use Agreement without a prior notice. In this case, the Member may contest according to the procedures established by the CED and, if the CED acknowledges that the contest is reasonable, it immediately resumes the use of service.
    • The CED may limit the use of services based on the Member’s qualifications even after the Member signed the Service Use Agreement and was given with an ID and password.

Chapter 6. Compensation for Damages

Article 20. Indemnification
  • If the CED is unable to provide the Service for natural disasters and the similar level of national emergencies, an act of God or any equivalent force majeure, the CED shall not be liable for providing services.
  • The CED shall not be liable for interruption of Services due to reasons attributable to the Members such as intentions or negligence.
  • The CED shall not be liable for the Service not being able to be provided due to unavoidable reasons based on the nature of telecommunication services or if the Service Provision is temporarily suspended for change, replacement and update of the Service provision related system.
  • The CED shall not be liable for the loss of the Member’s information due to the Service being terminated for reasons attributable to the Member.
  • The CED shall not take responsibility if the Member does not receive benefits expected from the service provision of the CED or if damages are incurred by use or selection of service data and potential value accompanied with the Service.
  • In no event will the CED be held liable for the accuracy, reliability, etc. of any information, reference or fact posted by a Member in connection with the Service.
  • The CED shall not be liable to intervene in any disputes between Members and third parties made through the Service and further the CED shall not be liable for any damages caused.
Article 21. Dispute Resolution
  • Members and the CED shall discuss and consult in good faith to amicably resolve the problems and matters caused regarding the use of Service.
  • Notwithstanding the foregoing Paragraph 1, the court applicable to the location of the CED shall have jurisdiction for any litigation of disputes between the CED and Member(s).
  • Lawsuits filed between the CED and the Member are applied with the laws of the Republic of Korea.
